Physician's Mistake Causes Brain Injury; Hospital To Pay $15M

Those in Franklin, Ohio, may be interested to know that a Snoqualmie family was recently awarded $15 million after their daughter was injured due to a physician error. According to reports, the four-year-old girl was a heart-transplant patient at the University of Washington hospital and Seattle Children's Hospital and was being treated for a cold when a consulting doctor did not repeat back the correct instructions on which medications the girl would be able take. Afrin, the nasal spray the four-year-old's mother was told was acceptable, is known to cause elevated blood pressure that could be damaging to a heart transplant.

According to reports, the girl was given the nasal spray approximately ten minutes before she stopped breathing. Her mother called 911 and began CPR until paramedics arrived and were able to resuscitate the child. After a series of tests and scans, doctors told her mother that the four-year-old girl had significant brain damage.

A trial took place at the King County Supreme Court, and following three weeks of the trial and six weeks of contemplation behind closed doors, the judge ruled in favor of the family, as he believed that the use of Afrin had caused the cardiac arrest that caused the child's brain damage. While we often have little choice but to place all of our trust in a doctor's hands, physician error is far too common, and the consequences can be grievous. If you or a loved one have experienced a similar case of medical error, it is essential to fully explore your legal options.

Multiple compensatory damages may be recovered and attorneys can compassionately guide you through every step of the process to hold a negligent party accountable.

In this case, the family sought the aid of the court, since the medical negligence and doctor's error was clear. Since the evidence was provided in court, the University of Washington and Seattle Children's hospitals will allegedly not appeal the decision.
