Son wins malpractice suit after his father passes away

Franklin, Ohio, readers may have been faced with a wrongful death in the past, and if so, know that it can be troubling to those involved. If you've been keeping track of medical malpractice news, you might have heard about this story. The case itself has been in court for over five years waiting to be resolved, and as of Oct. 19, it was won by the son of a man who died due to preventable blood clots.

According to this story, the then 77-year-old man had gone into the Broward General Medical Center in 2008 for knee surgery. With any surgery like that, doctors tend to prescribe blood thinners or medications to prevent clots, as the legs are known to clot after surgery, and this can result in dangerous embolisms. Unfortunately, the 77-year-old man was not prescribed any blood thinners to prevent the clotting, and he passed away only five days after the surgery due to a pulmonary embolism. It was believed that the blood clots that killed him were from the surgical site.

The hospital representative stated that this was just an innocent mistake made by the medical provider, but the man's son did not agree. The courts sided with him, and after a short two-day hearing, the judge found that the hospital district had provided intentionally misleading testimony to try to win the case; the judge allegedly ordered the hospital's taxing district to drop its defense and to pay the opposing party's attorney fees. Next, they will have to finalize the settlement, although an amount was not discussed in the report.

In this case, a common treatment was missed, and that is what is believed to have been the reason for a man's death. If you have lost a loved one due to negligence, you may want to look into your options.
