Charges against Ohio mother in intoxicated teen driver’s death

Criminal charges have been filed against a Fairfield, Ohio, woman who prosecutors claim furnished intoxicating beverages at a New Year's Eve party at her home to underage friends of her daughter. A 20-year-old male who attended the party drove off in his Ford Mustang early on New Year's Day and was involved in a single vehicle crash at approximately 4:50 a.m. He suffered injuries that required he be flown to the University of Cincinnati Medical Center for emergency surgery, but he died just two days later.

The Ohio Department of Public Safety has a unit that carries out an investigation following an Ohio car accident resulting in a serious injury or a death. The goal is to determine whether alcohol was involved in the accident and was either provided to an underage driver or to someone already previously intoxicated. In this case, authorities believe, the 52-year-old mother provided beer to the driver and other underage people at the party.

Accident victims or their surviving families may have viable claims against either businesses or private individuals from accidents that result in serious bodily injuries or death because of intoxicated driving.

Not all such lawsuits are against motorists. In wrongful death lawsuits, filed for the benefit of an fatal accident victim's surviving family, there can be recovery for medical and funeral expenses, pain and suffering, lost support and services, and other economic losses. In personal injury lawsuits, there can also be recovery for resulting disability and loss of earning capacity, as well as future pain and suffering and future anticipated medical needs.
