Establishing fault in Ohio truck accidents

When a truck accident happens, those who are not at fault in the incident could suddenly be facing thousands of dollars of medical bills. To determine if they have a right to compensation for these costs, many factors have to be considered, including who is at fault in the accident. One way to start this process is by looking at some of the main reasons why truck accidents occur, which can help establish the at-fault party.

To begin with, the accident could have happened because of negligence on the part of the truck driver. If the driver was speeding or driving in a reckless and dangerous fashion, he or she may have been negligent. This can also apply if the driver was overly fatigued while behind the wheel or driving while under the influence of alcohol or drugs.

Another common reason for truck accidents is failure of the equipment. If a tire blows out because it was not checked frequently and replaced when needed, the truck could go out of control. If the truck's load was not secured properly and it shifts while the vehicle is in motion, it could also cause an accident.

Sometimes, the fault may even lie with the trucking company, if not with the driver. For example, the company may not have maintained their vehicles properly, or they may have scheduled the driver to work for too many hours.
