Little League Baseball Brain Injury Ends In $14.5M Settlement

A controversial brain injury lawsuit recently ended with a settlement agreement. The suit involved devastating injuries sustained by a boy during a youth baseball game. The victim was playing pitcher when the batter crushed the ball, sending it right into his chest. The force caused the boy's heart to seize and he was deprived of oxygen for 15 to 20 minutes, according to his attorney.

The boy suffered serious brain damage; he requires around-the-clock care and cannot perform any daily functions. The victim will remain in a near-vegetative state for the rest of his life.

The boy's parents brought a lawsuit against a number of parties, including the manufacturer of the bat, which was metal. The victim's parents and their lawyer believe that metal bats have no place in youth baseball, as they add unnecessary speed to the ball - beyond that of a wooden bat - when contact is made.

The lawsuit involved a variety of complicated legal issues, including:

  • Assumption of risk, where a participant - or his parents - assume the risk of injury when the child agrees to participate in the activity
  • Product liability, which involves the dangerous nature of a product and the foreseeability of the harm it has caused

The family recovered $14.5 million on behalf of the injured boy. That sum may seem like a lot, but it will only provide the victim with medical care throughout his lifetime.
