Child suffers serious brain injury on cruise ship

All the family wanted was a nice vacation on a cruise ship. It turned into a nightmare, though, when a couple's 9-year-old son was injured playing a kids' game onboard, and had to be rushed off the vessel for emergency brain surgery at a hospital. The ship, operated by Royal Caribbean Ltd., offered a child's entertainment zone for children, promising safe activities.

The game which resulted in the boy's brain injury in this case involved members of the cruise ship having children run and avoid balls that were hurled at them from the side. Unfortunately, the boy ran into another child also playing in the same confined space, and then hit his head on a "hard surface," resulting in the brain trauma.

Moments later, the boy had "projectile vomiting," and the family was glad that the cruise ship not at sea, making it possible to quickly transport him to an emergency medical facility. The family believes that the game was unreasonably dangerous and is concerned that the child may experience epilepsy-type seizures in the future as a result of what occurred.

Such accidents can happen in many settings, including at a daycare center, playground, school or play areas at a fast food restaurant. When such facilities take on the responsibility of supervising children at play, they have a clear legal duty to protect them against unreasonable risks of injury.
