Ohio University settles lawsuit over medical malpractice

Those in Franklin, Ohio, will be glad to hear that Ohio University is paying for a recent medical mistake that resulted in the amputation of a student's right arm, shoulder, and shoulder blade. The student sought help for the infection in 2007, and she believes the misdiagnosis led to her present condition.

According to the report, the university has agreed to pay a $250,000 settlement in the medical malpractice lawsuit. This settlement has been capped at $250,000 by an Ohio law stating that cases against universities may not pay out more than that when filed with the Ohio Court of Claims. The lawsuit claimed that the university's Hudson Health Center misdiagnosed the student's condition in 2007, which left her unaware that she was infected with flesh-eating bacteria. This misdiagnosis eventually led to her right arm, shoulder, and shoulder blade being amputated to save the rest of her body from the bacteria, according to reports.

The University is not admitting liability, according to the settlement, and the woman has attempted to challenge the $250,000 cap on non-economic damages in Ohio Court of Claims cases brought against universities, as she is allegedly claiming the cap as unconstitutional. The woman also has additional court cases in place; however, this settlement is supposed to cover all cases in the court, according to the document.
