New charges filed against Ohio spine surgeon

Regular readers may remember a story posted here in July about an Ohio spine surgeon who was facing federal charges for health care fraud, as well as civil lawsuits by more than 160 patients who claim he subjected them to unnecessary and sometimes harmful surgeries. A new federal indictment has been unsealed, and it will make things even worse for the Ohio physician.

The indictment contains 36 counts ranging from "leaving a broken guidewire in a patient during surgery" to having others write out prescriptions for Oxycodone. The indictment also charges the surgeon with performing unnecessary surgeries on 10 patients and making false diagnoses.

One of the attorneys who is representing one of the doctor's alleged victims said that he hopes that the medical boards in Ohio and Kentucky revoke his medical license. The defendant's attorney said that the new charges are not surprising, but would not comment on what the other attorney said.

The physician is alleged to have committed millions of dollars in heath care fraud. Prosecutors say he billed public and private health care programs for services that were never received by patients. He has pleaded not guilty to those charges. The trial is expected to begin on Jan. 13. The doctor faced up to 125 years in prison if he is convicted. The indictment also wants all of the doctor's profits and proceeds that he made from the medical services scam.

The long list of civil cases is scheduled to start on Jan. 6. All of the doctor's current privileges at Ohio hospitals have been pulled. He is part owner of the Centers for Advanced Spine Technologies (CAST). There are also allegations that the doctor hid the that fact that some hospitals had disciplined him, and he also had other medical malpractice cases file against him in the past.
