Woman from Kenton sues over son's death

If you've been to Lima, Ohio, you might be interested in hearing about this medical malpractice case that was recently launched against three doctors who allegedly didn't deliver a baby in time to prevent his death. According to the news report, the medical mistake resulted in the death of the child because he outgrew his mother's womb.

The news report from Dec. 5 states that the woman is claiming that the three doctors involved in the case did not provide a professional diagnosis, the attention she needed, or the treatment that would be required in her situation. At the time of his birth, the doctors stated that the boy was 13 pounds and 12 ounces, which is recorded as being the 75th percentile of a 3-month-old child, according to the Centers for Disease Control growth chart for boys from birth to 36 months.

The doctors have denied that they were negligent in the woman and baby's care, but they are also claiming that the statute of limitations for the lawsuit makes it invalid. According to the news, the little boy died on June 18, 2009, which may have been too long ago for the woman to file a complaint. The doctors are asking for the lawsuit to be dismissed. The woman is asking for over $25,000 in her lawsuit, because she claims she incurred funeral and medical expenses. She is also seeking compensation for her mental anguish and emotional distress caused by her son's death.
