Child receives $32.8 million payout for birth injuries

It's unfortunate, but injuries suffered at birth can be life altering and may not be reversible. In this case, birth injuries have left one child with spastic quadriplegic cerebral palsy. Readers in Ohio might be interested to know that the child has now been awarded with $32.8 million, which can be used to help better her life.

In this case, the child's mother went into labor at Phoenixville Hospital in Pennsylvania. It was on Nov. 12, 2009, which was on schedule with the woman's due date, and she also had no major concerns, according to reports. According to a time line that was provided, the child's heart rate dropped at around 1:07 a.m. from around 150 beats per minute, a normal rate, to 60 beats per minute, which is unusual. It is expected that the child's brain wasn't receiving oxygen because of a kink in the umbilical cord.

It was believed that the nurses attending the girl's pregnant mother were negligent, leading to the little girl's injuries. Instead of alerting the doctor to the issues, they allegedly waited. It wasn't until the doctor came into the room at around 1:20 a.m. and saw the change, and nothing had been done. The doctor ordered an emergency cesarean section delivery upon seeing the change, and she told the nurses to contact a superior. According to the reports, the superior wasn't contacted until 1:29 a.m., and an anesthesiologist wasn't found until 1:36 a.m. The little girl was born just a few minutes later at 1:49 a.m.

The jury of four women and eight men determined that the nurses had failed to alert the doctor about a major change in the little girl's heart rate during her birth, and by waiting a shocking 13 minutes, caused her brain damage that is lasting and permanent.
