Couple will sue doctor in alleged forceps-caused brain injury

Anytime an individual submits to medical procedures, he or she is putting a lot of trust and faith in medical staff. During a pregnancy, the mother is trusting both her own safety and that of her unborn child to doctors, nurses and others. After the death of their days-old child, one couple is alleging that a preventable birth injury occurred due to a doctor's actions.

According to the couple, the doctor attempted to deliver the baby using forceps. One family member states that the doctor was very forceful during the procedure, and she also stated that family in the room heard a sound like the baby's skull being crushed. After the birth, the baby was transferred to another facility for treatment, where the family was allegedly told that the baby had skull fractures.

One family member states that the mother approached the physician prior to Christmas. She asked for a scheduled C-section delivery, because she didn't believe the baby could be delivered naturally. The doctor refused; according to the family member, the doctor told the young mother that she didn't want to have a C-section due to the scarring.

In the end, the baby was born by emergency C-section. According to the family, the mother had a 103 degree fever and had been in labor over 24 hours. The baby was taken off life support several days after the birth and died on Jan. 2.

The family reports that they will sue the doctor but not the hospital. They state that they feel like the death of their daughter is due to negligence on the part of the doctor, but that the hospital staff did everything they could.
