Ohio judge sentences man for crash he claims not to remember

More than four years after a crash he says he says he doesn't remember, a 46-year-old man has been given a six-month jail sentence by an Ohio judge. He was charged with aggravated vehicular assault. Although he originally faced two counts, one of them was dropped in a plea deal.

The defendant was not indicted until more than three years after the Jan. 2010 accident. Because the collision occurred not far from the Ohio border, on Route 14 in Pennsylvania, there were some jurisdictional issues regarding which state's authorities should investigate it. Ohio Highway Patrol officers investigated the crash, and Ohio emergency workers were at the scene.

The 57-year victim was traveling eastbound on Route 14 when the defendant's vehicle, which was driving in the opposite direction, crossed over the line and hit him head-on. Both men were seriously injured.

According to defendant's attorney, his client takes responsibility for the accident. Although it was specifically reported that alcohol was a factor in the crash, the attorney said that the man "has not taken a sip of alcohol since that day." The attorney had asked for probation for his client, who reportedly has only an elementary-school reading level.

It was not reported whether the victim has sought any sort of civil damages from the defendant. Even if there are delays in the filing of criminal charges against an alleged at-fault driver, victims and their families sometimes proceed with civil litigation in order to help recoup damages needed to cover medical treatment and other expenses. Ohio car accident victims can often benefit from early consultation from a personal injury attorney to help determine the best course of action.
