Mother claims doctor’s negligence led to injured newborn

A woman in another state has sued the doctor that delivered her baby on behalf of the child who continues to suffer from birth injuries. The lawsuit claims that the doctor committed medical malpractice by leaving the baby for dead for four hours instead of immediately putting the baby under the care of a pediatrician in a neonatal intensive care unit.

The baby was born in 2009. He had irregular gasping breaths and an irregular heartbeat, but was born alive and a nurse noted that he made a small cry at birth and moved his limbs, according to an article in The Tennessean. According to the lawsuit, the doctor made the judgment that the baby would not live and the baby was placed in a plastic tub, where he remained for four hours. The lawsuit says that the baby suffered injuries because he was neglected after birth.

After four hours, a nurse passed by and noticed that the baby was gasping for breath. The baby was then placed under the care of a pediatrician and transferred to another hospital where he spent three months in specialized care. He now continues to suffer the effects from a brain injury and other injuries. The lawsuit places the fault for the baby’s injury on the neglectful treatment of the doctor who delivered the child.
